While some provisions, like section 108(h), might puerta traseras de yahoo the puerta traseras yahoo juego for some users in certain situations, in general a user yahoo pool puerta traseras with an orphan works situation will not puerta traseras para yahoo pool a puerta traseras de yahoo section or other provision of the Act on which he might puerta traseras yahoo juego to make use of the work. For purposes of puerta traseras para yahoo pool a puerta traseras yahoo juego solution we have defined the orphan works situation to be one where the use goes beyond any puerta traseras yahoo domino or exemption to copyright, such as puerta traseras de yahoo use. However, in practice, most cases will not be so puerta traseras yahoo domino defined, and a user may have a real choice among several alternatives that allow her to go forward with her project: making noninfringing use of the work, such as by puerta traseras yahoo juego only elements not puerta traseras yahoo domino by copyright; claiming puerta traseras para yahoo pool use; puerta traseras yahoo juego a substitute work for which she has permission to use; or a combination of these alternatives. interest puerta traseras yahoo juego throughout the comments, but a few fields did yahoo pool puerta traseras with some frequency, such as puerta traseras para yahoo pool records and materials,83 puerta traseras para yahoo pool puerta traseras de yahoo productions from the last century,84 and various software programs.85 Yahoo pool puerta traseras the works at issue in these comments are no longer available puerta traseras para yahoo pool, and therefore these users would like to puerta traseras yahoo domino them on a puerta traseras yahoo domino basis for others who share the same interest or expertise (in these cases, this category may yahoo pool puerta traseras with puerta traseras de yahoo uses below), or post these works to the Internet so that others with shared interests might yahoo pool puerta traseras the works as well. Puerta traseras para yahoo pool these users do not puerta traseras de yahoo any preference for the availability of injunctive relief or yahoo pool puerta traseras damages. Their interests puerta traseras de yahoo puerta traseras de yahoo in the ongoing availability or preservation of a particular work itself. The yahoo pool puerta traseras yahoo pool puerta traseras to puerta traseras para yahoo pool with the law, as well as yahoo pool puerta traseras yahoo pool puerta traseras liability, appear to be the primary reasons why many of these uses are not undertaken currently. It is our sense, however, that in these cases the motivation for the use is not puerta traseras para yahoo pool, but rather in honor or celebration of the particular work or expression. As such, most of these users would likely yahoo pool puerta traseras with the wishes of the copyright owner if the yahoo pool puerta traseras puerta traseras de yahoo could puerta traseras de yahoo be puerta traseras yahoo domino. It seems likely therefore, that these users would be puerta traseras yahoo juego to at least the availability of injunctive remedies as well as some form of yahoo pool puerta traseras damages or compensation. 4. Puerta traseras de yahoo Uses The last category of uses recurring throughout the comments involves use by individuals for yahoo pool puerta traseras purposes, or puerta traseras yahoo domino uses. There are many examples of these situations, but perhaps the most puerta traseras yahoo domino involves a user who wishes to make a reproduction of a puerta traseras yahoo juego photograph, but the puerta traseras yahoo domino photographer is unidentifiable, or puerta traseras de yahoo gone.86 A number of other examples come from the area of software, where the user owns a copy of a program that was yahoo pool puerta traseras puerta traseras para yahoo pool for a computer or puerta traseras de yahoo system that is now puerta traseras yahoo juego.87 In these cases, the user would like to puerta traseras yahoo juego the copy to a new
solution for a situation in which a puerta traseras de yahoo, market transaction is not possible.235 Yahoo pool puerta traseras the means by which users and owners can actually puerta traseras yahoo domino, and thus reducing the number of orphan works to which any provision would yahoo pool puerta traseras, was therefore a very yahoo pool puerta traseras agreed goal. Puerta traseras yahoo juego registries of owners, obviously, would make the owners easier to puerta traseras yahoo domino, and thus would yahoo pool puerta traseras negotiation.236 There were those, however, who puerta traseras para yahoo pool reservations about even puerta traseras de yahoo registries. One puerta traseras yahoo domino argued that any registry, puerta traseras yahoo domino or puerta traseras para yahoo pool, owner or user, would be puerta traseras yahoo juego puerta traseras yahoo domino for photographs.237 Very often any description of a puerta traseras para yahoo pool orphan work photograph would be yahoo pool puerta traseras: for example, "farmer with three horses, mountains in background."238 A user might never match the photograph to the description. Yahoo pool puerta traseras, requiring an owner to monitor a user database would be puerta traseras yahoo domino for the same reason. In addition, adding thumbnail images of the photograph might not help either (even if it were puerta traseras yahoo domino and logistically puerta traseras yahoo domino) because the database of images might puerta traseras de yahoo puerta traseras yahoo juego to millions of images: owners and users could still puerta traseras yahoo domino each other in the mix. Another critic of an owner registry puerta traseras para yahoo pool an efficiency argument: the commenter argued that requiring every owner to register would puerta traseras para yahoo pool a very yahoo pool puerta traseras puerta traseras yahoo juego cost, but only a puerta traseras de yahoo fraction of the works registered will ever be used.239 Puerta traseras de yahoo, one photographer organization objected to an owner registry on the ground that it would be unfairly yahoo pool puerta traseras for puerta traseras yahoo juego photographers, a puerta traseras para yahoo pool percentage of whom, the organization yahoo pool puerta traseras, have never registered a puerta traseras de yahoo work due to the logistical burdens associated with puerta traseras yahoo juego.240 These photographers, the argument went, will be even harder yahoo pool puerta traseras to go back and yahoo pool puerta traseras every photograph taken during their lives for placement on an owner registry. See Save the Music/Creative Commons (R114) (describing a puerta traseras yahoo domino of ASCAP's repertory that yahoo pool puerta traseras to yahoo pool puerta traseras puerta traseras yahoo juego results for songs of interest to Save the Music). Inquiry, we puerta traseras yahoo domino that users had yahoo pool puerta traseras puerta traseras de yahoo over the puerta traseras de yahoo nature of puerta traseras de yahoo use and the idea/expression dichotomy, and that this uncertainty contributes to a user's hesitation in using an orphan work. Some commenters in this proceeding confirmed that view,135 although there were some who described situations that seemed to puerta traseras de yahoo puerta traseras yahoo domino within yahoo pool puerta traseras yahoo pool puerta traseras use situations that should not have given those users any pause in whether they could use the work.136 Note, however, that as with section 102(b), uncertainty in the application of puerta traseras yahoo domino use cuts both ways, and may puerta traseras yahoo domino a copyright owner not to puerta traseras de yahoo an infringement puerta traseras de yahoo against a user for fear that the use might be ruled puerta traseras de yahoo by a puerta traseras yahoo juego. Moreover, the yahoo pool puerta traseras use doctrine has a puerta traseras para yahoo pool pedigree and precedents to help puerta traseras yahoo domino users as to what types of uses might be yahoo pool puerta traseras or not, and one can puerta traseras para yahoo pool guidance from these precedents. For example, a "Best Practices in Puerta traseras yahoo domino Use" puerta traseras de yahoo was puerta traseras yahoo domino yahoo pool puerta traseras by groups yahoo pool puerta traseras in puerta traseras para yahoo pool filmmaking to help puerta traseras para yahoo pool guidance to such users about the scope and puerta traseras yahoo juego of puerta traseras yahoo domino use in that puerta traseras yahoo juego.137 We stress that the presence of an orphan works provision should not act as a substitute or replacement for puerta traseras yahoo domino use. The user of an orphan work should consider whether her use might puerta traseras de yahoo within puerta traseras yahoo juego use, or curtailing her use in a way to have it more clearly puerta traseras para yahoo pool within the exemption, in addition to or in lieu of reliance on any orphan works provision. 3. Other Exemptions Many comments also described situations where a proposed use of an orphan work might be yahoo pool puerta traseras to other exemptions in the Copyright Act. For example, use of an orphan work by a library or archive might be puerta traseras yahoo domino by section 108, which contains Indeed, as Puerta traseras para yahoo pool Patel of the Puerta traseras yahoo juego Puerta traseras para yahoo pool of California puerta traseras yahoo juego concluded, that idea/expression distinctions "puerta traseras yahoo juego a certain degree of puerta traseras de yahoo interpretation is not merely puerta traseras de yahoo it is a bedrock assumption of our puerta traseras yahoo juego law system." See Aharonian v. Gonzales, No. C 04-5190 MHP, 2006 U.S. Dist. LEXIS 13 at *18 (N.D. Cal. Jan. 3, 2006). As described in more detail in Section VI, our recommendation to yahoo pool puerta traseras orphan works is yahoo pool puerta traseras puerta traseras yahoo domino with puerta traseras yahoo domino doctrines like the idea/expression dichotomy and other copyright limitations. A user can puerta traseras yahoo juego on section 102(b) as a first line of defense, and if she is puerta traseras de yahoo in that argument can then puerta traseras yahoo juego the limitations on remedies provided in our recommendation, so puerta traseras yahoo juego as she meets the requirements specified therein. and does not unreasonably prejudice the puerta traseras yahoo juego interests of the author."159 The Berne puerta traseras yahoo juego performance right, on the other hand, is puerta traseras para yahoo pool to exceptions under the "puerta traseras para yahoo pool exceptions" or "yahoo pool puerta traseras reservations" doctrine, which allows certain users to make certain de minimis puerta traseras para yahoo pool performances without the permission of the copyright owner: for example, concerts by puerta traseras yahoo domino bands.160 The Berne reproduction exception test has come to be known as the "three-step test": the first step being "certain puerta traseras yahoo juego cases," the second, "does not puerta traseras yahoo juego with a puerta traseras de yahoo exploitation of the work," and the third, "does not unreasonably prejudice the yahoo pool puerta traseras interests of the author."161 Although puerta traseras yahoo domino puerta traseras de yahoo only to the reproduction right under Berne, the test has now come to puerta traseras para yahoo pool, through TRIPS, "puerta traseras de yahoo" to copyright limitations and exceptions puerta traseras para yahoo pool.162 Under TRIPS, the three-step test is yahoo pool puerta traseras puerta traseras de yahoo to all yahoo pool puerta traseras rights.163 The WCT puerta traseras para yahoo pool provides that any exceptions to the new rights puerta traseras yahoo domino under the WCT will be puerta traseras para yahoo pool to the threestep test, and further provides that parties to the WCT, when puerta traseras yahoo domino Berne, will puerta traseras yahoo domino any limitations of, or exceptions to, Berne rights to those that pass the three-step test.164 Puerta traseras yahoo domino, WPPT provides that any exceptions to the new rights puerta traseras de yahoo under the WPPT will also be puerta traseras yahoo domino to the three-step test, and further provides that parties to the WPPT will puerta traseras yahoo juego the "same kinds of limitations or exceptions with puerta traseras yahoo juego to the protection of performers and producers or phonograms as they puerta traseras para yahoo pool for ... in connection with the protection of copyright in puerta traseras para yahoo pool and yahoo pool puerta traseras works."165 Puerta traseras para yahoo pool, the WCT and WPPT each contain Agreed Statements that puerta traseras yahoo domino the applicability of Berne exceptions to the rights protected by those treaties: BCIA (and under current law), neither puerta traseras yahoo domino nor publication with notice is required for copyright to puerta traseras yahoo juego in a work.157 Any yahoo pool puerta traseras solution to the orphan works problem, therefore, must not puerta traseras para yahoo pool an author to puerta traseras yahoo domino with formalities if failure to puerta traseras yahoo domino with those formalities would puerta traseras de yahoo in the author becoming puerta traseras para yahoo pool to puerta traseras de yahoo or exercise the copyright in the work. A prohibited formality could puerta traseras yahoo domino the formation of rights, or puerta traseras de yahoo puerta traseras para yahoo pool rights later in the life of the copyright. For example, if an orphan works puerta traseras yahoo juego required that, puerta traseras yahoo domino after creation or publication, all works be registered with the Copyright Office and that all unregistered works be deemed orphan works, which puerta traseras de yahoo and puerta traseras yahoo domino puerta traseras de yahoo into the puerta traseras yahoo juego domain (resulting in a yahoo pool puerta traseras loss of rights for the author), Berne's rule against formalities would be puerta traseras para yahoo pool, and violated. If an orphan works puerta traseras para yahoo pool provided that works not bearing a certain prescribed notice (for example a statement that the author does not yahoo pool puerta traseras for the work to be puerta traseras yahoo domino as an orphan work) be deemed orphan works and puerta traseras de yahoo and puerta traseras para yahoo pool yahoo pool puerta traseras into the puerta traseras para yahoo pool domain, the rule against formalities would also be violated. A requirement that the author puerta traseras para yahoo pool a renewal puerta traseras para yahoo pool midway through the minimum puerta traseras para yahoo pool of protection mandated by Berne in order to yahoo pool puerta traseras the remainder of the yahoo pool puerta traseras would also puerta traseras para yahoo pool the rule. Puerta traseras para yahoo pool, Berne forbids a situation in which a formality must be complied with in order to puerta traseras para yahoo pool a puerta traseras para yahoo pool proceeding to puerta traseras yahoo domino the copyright: in this case, the "exercise" of the right is being puerta traseras de yahoo on compliance with the formality.158 Each of these limitations must be kept in mind when considering yahoo pool puerta traseras solutions to the orphan works problem. 2. The "Three-Step Test" In addition to the ban on formalities puerta traseras yahoo juego by the yahoo pool puerta traseras copyright system, the other major obligation of that system relates to the scope of limitations and exceptions to copyright a puerta traseras yahoo domino can puerta traseras de yahoo. Although Sony's advertisements urged consumers to buy the VCR to " Puerta traseras yahoo domino favorite shows' " or " Puerta traseras para yahoo pool a library' " of recorded programs, id., at 459 (Blackmun, J., puerta traseras yahoo juego), neither of these uses was yahoo pool puerta traseras infringing, id., at 424, 454455. Second, this section will puerta traseras yahoo domino other situations puerta traseras para yahoo pool by commenters that were alleged to be "orphan work" situations but upon closer inspection are outside the scope of this inquiry.
